Part 1 : Theory

“Private Property has been and still is the holy grail of our ‘civilized’ societies”

 »Private property” = stolen good

For we brought nothing into this world, and it is certain we can carry nothing out.” [Timothy 6:7]

The 3 approaches :

  1. Deism says that God created everything, thats why He/She possesses all; we have the land in dominion, we are  »Servant Kings »

  2. Agnostics hold that we do not know who created everything; however, we do know it was not us.

  3. The law of the jungle holds that the human race consists of successful wolfs and obedient sheep; they live entirely in the world  »after the apple » (they do not want to simply live after the divine Law (do what you want without hurting another being), they wanted to create their own law, wanted to be small gods; what has been de jure became de facto)

The logic of property :

  1. Property is the possession by one individual (can be a group) under the exclusion of all others = exclusiveness: the owner has the exclusive right to use her/his property until the Creator wants to repossess it (Canada criminal code sections 38/39: you could defend your property with a valid claim of rights – repealed)

  2. The property is used without condition: taxes and bylaws; if I possess a property there can be no condition to it’s usage

The governments:

  • Legal rights and equity rights

  • Under Section 92, subsection 8 of the British North America Act (BNA), the provinces have the authority to grant permission to the Municipalities to create by-laws. When Municipalities implement by-laws that are in conflict or frustrate Acts of Parliament, superior legislation, Crown contracts or Crown Grants/Letters Patent, the Council and staff can be found liable to tort action. This includes all members of staff, particularly, the by-law inspector, Clerks, CAOs, and Council, as it is function of these entities to know and understand the implication of all Acts and any conflicts/frustrations that may arise.
  • Trespass of Chattel occurs when the tortfeasor intentionally deprives or interferes with the chattel owner’s possession or exclusive use of personal property. The tortfeasor’s possession or interference must be unauthorized, which means that the owner cannot have consented.”

  • The governments on all level have only jurisdiction over public land = crown land

The logic of taxation :

You have to pay money to use what you own and you have to pay money to keep what you own.

The right to confiscate requires that the municipality has granted the same property before; which is never the case.

Taxation applies to government agents = agent, employee of the government = resident;

The municipality = corporation VILLE DE PRÉVOST = a fiction (like the sales territory of coca-cola) in which nobody could ever take residence > you ask for the proof that corporate regulations or bylaws have force outside the sphere of their corporation

REMEMBER THAT YOU ARE NOT THE LEGAL PERSON


Part 2: Practice

The logic of the remedy:

Gather the 3 documents: the land title, the survey certification and the sales contract; send these 3 documents attached to your Notice of Understanding

The Land Title

= document which proves the alienation of a land from the crownland into private hands = certification that you are the exclusive owner

This is normally included in the sales contract; if not ask your municipality for the survey company who works for them and ask them for the certified copy.

Partie théorétique

 »Propriété Privée” = Bien volé

“Parce que nous ne sommes venus avec rien au monde; et il est certain que nous n’emmèneront rien non plus lorsque nous quitterons ce monde.” [Timothy 6:7]

Les 3 approches vers la vie:

  1. Déisme (dieu a créé le tout, donc c’est elle qui le possède; et nous avons la terre en dominion :  »roi servant »)
  2. Agnosticisme (nous ignorons qui a crée le monde; mais nous sommes certain que ce n’était pas nous)
  3. Loi de la jungle (l’espèce humaine-les loups et le moutons; état des choses après la pomme (nous ne voulons plus vivre sous la Loi); droit légal + droit d’équité (dispute de propriété devant une cour); (de jure versus de facto)

La logique de la propriété :

  1. La propriété est la possession d’un seul à l’exclusion de tous les autres = exclusivité
    domaine : nous avons les droits exclusifs d’utiliser la propriété jusque le créateur le possède
    code criminel du canada, section 38/39 : défense de la propriété avec revendication de droit (claim of right)
  2. La propriété peut être utilisé sans condition : taxes et règlements
    si je possède une propriété, il ne peut pas avoir une condition à l’utilisation de ce que je possède

Les gouvernements :

  • droit légal et droit d’équité
  • Section 92, subsection 8 du British North America Act (BNA), les provinces ont donné permission aux municipalités de créer des règlements, lois internes.  »Si une municipalité crée un règlement qui est en conflit ou qui frustre les actes du parlement, la législation supérieure, les contrats de la couronne ou les lettres patentes (titres), le conseil municipal et les fonctionnaires peuvent en être tenu responsable d’un délit. Cela inclut les inspecteurs, les membres du conseil municipal, le maire et les cadres car c’est leur devoir de connaître et comprendre les implications de tous leurs actes avec les conflits/frustrations qui peuvent en résulter.
  • L’outrance d’autorité est l’acte d’un auteur du délit qui déprave avec intention ou qui interfère avec la possession d’un propriétaire ou l’usage exclusif d’une propriété personnelle. L’interférence de l’auteur du délit doit être sans autorisation (= le propriétaire n’en a pas consenti).
  • Les gouvernements sur toutes les paliers ont seulement juridiction sur les terrains publiques = terres de la couronne

La logique des taxes :

 »Vous devez payer pour l’utilisation de ce que vous possédez et vous devez payer de garder ce que vous possédez »

La confiscation requis que la municipalité a accordé la propriété auparavant; ce qui n’est pas le cas.

La taxe s’adresse à la personne légale = agent, employé du gouvernement = résident;

la municipalité = corporation VILLE DE PRÉVOST = fiction (‘territoire de vente de coca-cola) dans laquelle ‘personne’ ne peut avoir résidence > demande de preuve que les règlements d’une corporation ont force au delà de la sphère de la corporation

Rassembler 3 documents : le titre, le certificat d’arpentage et l’acte de vente; ensuite les envoyer en attaché à l’Avis de compréhension

Fait normalement partie des papiers de l’acte de vente, sinon demandez à la municipalité qui a arpenté les terrains en question et demandez le certificat.

1ère lettre : Affidavit et avis de compréhension, demande et Intention

En envoyant une copie conforme de cet instrument à chacun d’eux, cet envoi est adéquat et complet, explicite ou implicite, sans recours et sans qu’il ne nécessite d’autre avis.

  1. Mentionnez ces deux phrases dans l’entête de la lettre :
    1. Ce document est un dossier publique.
    2. Avis au principal est avis à l’agent; avis à l’agent est avis au principal.

  7. Datez et signez votre lettre
  8. Demandez la signature/étampe d’un notaire (faut signer en présence de lui); la signature de 3 témoins est aussi suffisant
  9. Attachez les documents suivants :
    1. Copie du contrat de vente
    2. Copie du titre
    3. Copie de l’arpentage

Envoyez cette lettre par courrier recommandé requérant une signature. Après le délai de [15 jours]vous allez envoyer la deuxième lettre : L’avis de défaut


 

2ième lettre : L’Avis de défaut

C’est essentiellement la même lettre que la première, sauf vous mentionnez deux points de plus pour faire référence à la non-réponse :

    • [Que j’ai constaté que vous n’avez pas répondu à ma lettre dans le délai prescrit; et]

    • [Que je considère dorénavant que vous avez donné votre accord tacite à mes propos; et]

Envoyez cette lettre par courrier recommandé requérant une signature. Après le délai de [15 jours]vous allez envoyer la dernière lettre : L’avis final de défaut


 

3ième lettre : L’Avis final de défaut

C’est essentiellement la même lettre que la première, sauf vous mentionnez deux points de plus pour faire référence à la non-réponse :

    • [Que j’ai constaté qu’encore une fois vous n’avez pas répondu à ma lettre dans le délai prescrit; et]

    • [Que je considère que tous mes points sont dorénavant légalement contraignant pour toutes corporations, soit-elle municipale, régionale, provinciale, fédérale ou autre; et ]

Envoyez cette lettre par courrier recommandé requérant une signature. Après le délai de [15 jours]vous pouvez écrire un résumé qui contient

  • tous vos points de compréhension, intention et demande
  • la non-réponse des  »autorités » est un accord tacite
  • cet accord est un contrat d’adhésion

Définitions:

La plupart des définitions sont tiré du  »Black’s Law Dictionary ». Rappelez-vous que vous pouvez aussi établir vos propres définitions; particulièrement si vous ne comprenez pas une définition donné par quelqu’un d’autre. De toute façon il s’agit de VOTRE définition, comment vous comprenez la chose!

AFFIDAVIT – une affirmation sous sermon

TERRE – 1. un espace immobile et indestructible en trois dimensions qui consiste d’une partie de la surface terrestre incluant l’espace en dessous et par dessus, incluant aussi tout ce qui y pousse et tout ce qu’y est attaché. 2. une propriété ou un intérêt dans une propriété.

TITRE – 1. l’ensemble de tous les éléments (propriété, possession et garde) qui constituent un droit légitime de contrôler et de se débarrasser d’une propriété; c’est le lien légitime entre une personne qui possède une propriété et la propriété même. 2. l’évidence légitime des droits de possession d’une propriété par une personne; un instrument (acte) qui constitue une telle évidence.

INDÉFESABLE – quelque chose qui ne peut pas être défaite, révoquée ou annulée. Ce terme est typiquement appliqué par rapport aux biens immobiliers ou les droits qui ne peuvent pas être défaits.

INTÉRÊT – 1. l’objet d’un désire humain; particulièrement un avantage ou profit de nature financière. 2. une partie légale dans quelque chose; tout ou une partie d’une revendication juste par rapport à une propriété.

TERRE PRIVÉE – les mots  »terres privées » sont compris incluant toutes les terres qui étaient aliénées de la couronne.

PROPRIÉTÉ PRIVÉE – une propriété qui est protégé de affectation ou confiscation publique et par rapport à laquelle le propriétaire a des droits exclusives et absolues.

INTÉRÊT PUBLIQUE – 1. le bien être général de la domaine publique qui justifie la reconnaissance et la protection. 2. quelque chose dans laquelle l’ensemble du public est partie prenante; particulièrement un intérêt qui justifie les règlements gouvernementaux

PROPRIÉTÉ PUBLIQUE – une propriété qui est possédé par l’état ou la communauté, dont l’usage n’est pas limité à un individu.

PROPRIÉTÉ RÉELLE – la terre et tout ce qu’y pousse, tout ce qu’y est attaché ou construit; excluant tous ce qui peut être coupé sans endommager la terre.

PROPRIÉTÉ ABSOLUE – une propriété par rapport à laquelle un individu a l’entière autorité et contrôle.

FIEF SIMPLE ABSOLUE – la possession d’une propriété sans conditions par rapport à son usage et son débarras.

LIBERTÉ DE CONTRACTER – la doctrine que les gens ont le droit de s’engager légitimement; un concept judiciaire qui dit qu’un contrat est basé sur un accord mutuel basé sur le libre choix; et par conséquence il ne devrait pas être entraver par un contrôle externe comme l’interférence du gouvernement par exemple.

INSTRUMENT – un document écrit qui définit des droits, des obligations ou des responsabilités comme par exemple un contrat, un testament, un billet à ordre, un certificat d’action. C’est aussi appelé  »instrument légal ».

ACTE – tout instrument légal écrit qui affirme ou confirme quelque chose qui change de mains (un intérêt, droit, propriété) qui est signé, attesté et livré ou scellé (dans certains juridictions). Généralement un acte est associé au transfer d’un titre d’une propriété.

How to reclaim our property

Here are the main points to remember when (re-)claiming your property:

  1. Property is always exclusive to the one who owns it; it excludes every one else, especially every other PERSON. If you own something no-one else has any interest or right in it. Private property owners have an exclusive, indefeasible natural right to decide how to use their private property.
  2. The Letter Patent. A Letter Patent is a Certified True Copy. Everyone should be in possession of a certified true copy of the Crown Land Grant (Letter Patent) associated with their private, real property. If you are the current holder of a Letter Patent or an heir or a legal successor of it, you would be the exclusive beneficiary of it with or without being in possession of any other form of document evidencing legal title. You can become the current holder of the Letter Patent associated with our property, if you simply ask for it.
    A legal title is only a public record resulting from a transfer or change the  »registered » name associated with the holder of that legal title. T
    he registration does not do away with or diminish the effect of the Letter Patent, it merely supports who is the current beneficial holder of it in the form of a reasonable incontestable public record.
    In fact a Letter Patent is the record of the moment when a particular land was alienated from the Crown (public domain) and became private. If you have bought your land from a private person, then this proofs that since the emission of the Letter Patent the land has always been in private hands.
    In Quebec you can demand a certified true copy of the Letter Patent of your land form the register 
  3. Instrument of Transfer (Contract of sale). The Letter Patent together with a ‘registrable’ instrument of transfer (deed of transfer) can be used in support of a private Claim of Right to physical possession of the subject property from time to time thereafter.
  4. Survey Certificate. They should also possess a certified true copy of an accurate survey certificate for their property. This certificate establishes the extension, dimensions and localization of the land in question.
  5. Private Laws. The possession of a land enables the owner to draft and post their own private laws related to their private property where applicable.
     

Definitions:

Most definitions come from Black’s Law Dictionary.

LAND – 1. an immovable and indestructible three-dimensional area consisting of a portion of the earth’s surface, that space above and below the earth’s surface, and everything growing on or permanently affixed to it. 2. an estate or interest in real property.

TITLE – 1. the union of all elements (as ownership, possession, and custody) constituting the legal right to control and dispose of property; the legal link between a person who owns property and the property itself. 2. legal evidence of a person’s ownership rights in property; an instrument (such as a deed) that constitutes such evidence.

INDEFEASIBLE – means that which cannot be defeated, revoked or made void. This term is usually applied to an estate or right that cannot be defeated.

INTEREST – 1. the object of any human desire; especially advantage or profit of a financial nature. 2. a legal share in something; all or part of a legal or equitable claim to or right in property.

PRIVATE LAND – The words “Private Lands” shall be held to include all lands which have been alienated by the Crown

PRIVATE PROPERTY – Property – protected from public appropriation – over which the owner has exclusive and absolute rights.

PUBLIC INTEREST – 1. the general welfare of the public that warrants recognition and protection. 2. Something in which the public as a whole has a stake; esp. an interest that justifies governmental regulation.

PUBLIC PROPERTY – State or community owned property not restricted to any one individual’s use or possession.

REAL PROPERTY – Land and anything growing on, attached to, or erected on it, excluding anything that may be severed without injury to the land.

ABSOLUTE PROPERTY – Property to which someone has full and complete title to and control over.

FEE SIMPLE ABSOLUTE – Possession of property without any conditions for its use or discharge

FREEDOM OF CONTRACT – the doctrine that people have a right to bind themselves legally; a judicial concept that contract are base on mutual agreement and free choice, and thus should not be hampered by external control such as government interference.

INSTRUMENT -1. a written legal document that defines rights, duties, entitlements, or liabilities, such as as contract, will promissory note, or share certificate. -Also termed legal instrument

DEED : any legal instrument in writing which affirms or confirms something which passes, an interest, right, or property and that is signed, attested, delivered, and in some jurisdictions sealed. It is commonly associated with transferring title to property.

Requirements of ‘deeds’ (common law) :

  1. it must state on its face that it is a deed, using wording like  »this deed… » or  »executed as a deed »

  2. it must indicate that the instrument itself conveys some privilege or something to someone. This is indicated by using the word ‘hereby’ or the phrase ‘by these presents’ in the clause indicating the gift

  3. the grantor must have the legal ability to grant the thing or privilege, and the grantee must have the legal capacity to receive it

  4. it must be executed by the grantor in presence of the prescribed number of witnesses, know as instrumental witnesses (= ‘in solemn form’)

  5. a seal must be affixed to it. Originally, affixing seals made persons parties to the deed and signatures were optional, but most jurisdictions made seals outdated, and now the signatures of the grantor and witnesses are primary.

  6. It must be delivered to and accepted by the grantee.

Remedy to own your property

Remember that you cannot own the land. Remember that you are called to be a Steward to the land: your giving shall be to preserve and enhance it’s natural beauty; in turn you receive the land as a temporary gift for your enjoyment. In order to claim your birthright as a Steward, you may follow these steps:

Request the letter patent

Request the form for the letter patent from the Registrar of the Letter Patents at the following address either on their website (fill out, print, sign and fax) or they send it to you by regular mail.

  1. Choose under ‘Applying for a certified copy’ and
  2. click : ‘Access to the application form‘;
  3. in the section ‘Letters Patent’, fill out what you can (the technician will call you if she cannot find your lot with the info you have given)You fill it out with the primitive lot numbers of your property.
  4. Pay $3.50. After some 5-10 days later she will send you an email with your letter patent and a little more later you will get the original (certified true copy) by mail.

Request a certified survey document

Acquire a certified survey document from the surveyor who has surveyed your land; in most cases you will get that with the sales contract. If not go to your municipality and ask for the record of your land; most probably you’ll find there who did the survey. If not ask your municipality who generally does the surveys for them.

1st letter: Affidavit and Notice of Understanding and Demand/Intention

Write an affidavit to give notice of your understanding. It is important that “your understanding” is really YOUR understanding; to not write something that you copied but did not understand. I have written in square parenthesis suggestions what you could write; please use your own thoughts and your own words. Your affidavit should contain the following points:

  1. Introduce yourself. [I, aviram of the Mueller family, a living soul or a child of God]
  2. Write about your motivation to create this instrument. [I am writing this instrument with the motivation to start a dialogue which may foster mutual understanding and prevent future conflict based on misunderstandings]
  3. Start sharing your understandings [Please take notice that it is my understanding:]
    • [That God is the creator of this land and HE only can have possession of it]
    • [That God has given us dominion of the land until HE repossesses it]
    • [That this land has been alienated from the Crown at … date. I affix a certified true copy of the Letter Patent which I have received from the Registrar of Quebec]
    • [That this land has the localization, extensions and dimensions as shown in the Certified True Copy of the Survey that I have also affixed]:
      Municipality or assessment district; Lot or Section; Admeasurement or area.
    • [That no person, including any government, provincial, municipal or other corporation has any right, title or interest in this private dominion; this includes personal property and real estate (land and buildings)]
    • [That any claim that a municipality, county, province or any other corporation makes on this dominion can be deemed as trespass of chattel]
    • [That this property is owned (not formulating that “I own it”) under fee simple absolute, meaning that I may use this land free of conditions;]
    • [That property tax and city codes, by-laws and statues are conditions of use; and that no corporation including but not limited to municipality, MRC, province has any authority to enforce conditions on me for the use of this property]

Part 1: Theory

 “Private Property has been and still is the holy grail of our ‘civilized’ societies”

Definitions: “private” comes from the Latin “privare” means steeling, robbing; “property” comes from the Latin “propietas” meaning “ownership” or “quality”. So the establishment of “private property” signifies a change of quality of a particular thing: it acquired the quality of a stolen good.

The premises:

“For we brought nothing into this world, and it is certain we can carry nothing out.” [Timothy 6:7]

At birth, we entered the world without anything, no property. Everything was already there. When we die, we will leave this world of things and cannot take anything with us. For the short period in between we could cherish the illusion to possess something, get attached to this illusion and have great pain and suffering when we are called to leave…

One of the most fundamental concepts of law is that one can only apply his will or rules or laws to that which he owns. When you own something, you have absolute power over it; you can use it, enjoy it, destroy it, discard it, sell it, abandon it.

What can we legitimately own? Something we have created. If i make myself a cake with ingredients i own, then this cake will be mine; and i can do whatsoever i want with it: eat it, give it away, throw it away, sell it.. If a couple « makes » a child? They will say that the child is « their » child but not in the same way as a cake; they cannot sell it, they cannot destroy it… why? because a child is alive, has a life of it’s own and maybe more importantly, the parents really didn’t « make » it – you cannot make a child the way you make a cake: you can be instrumental to the creation of a new human being. That’s why you do not own it.

3levelsYet there have been times in our history where children could be sold, as slaves for example. That tells us that « property » is deeply connected to ethics. And in regards to ethics there are really only 3 different realms where we live in; or 3 different worldviews: Deist, Agnostic or Law-of-the-jungle. As Deists we believe that God has created the land as part of HIS Creation, while the Agnostics say: “We don’t know who created the world and we don’t know who created us”. The Lawyer-of-the-jungle will believe that humans are the superior race and inside that race there are superior and inferior individuals; the superior ones will take possession of some land and subsequently defend their “right” against another superior individual who claims the same land. Theists and Agnostics agree that you can only own something if you have created it. Lawyers-of-the-jungle will hold that you own something if you can take it and hold it.


Deist Approach – The divine logic of land property

godFor the the Theist God is the only legitimate owner of the land because SHE has created it; conversely it can never be man or woman who can own anything because they did not create it.
Then the deist will continue that God has given us dominion over the land, that we are Servant Kings on the land; and that we will use the land and everything on it to realize and share our talents and gifts. We use the land to be able to work as God’s hands. In this sense we can affirm that we are given the land until the Creator repossesses it.

All that exists must come from something (dependent origination) and nothing can come from nothing. And there must be some “first something” that has no cause, does not depend on anything and is therefore eternal – the infinite supreme being: God.

We don’t own any property – the Creator does and we have been given dominion over everything that is created (except our selves) to take care of this Creation – as Stewards, as Servant Kings.

In this scenario there is a God, who created and creates us and everything around us and who gave us dominion over it as a steward. [Webster : « In the beginning of the world, the Creator gave o man dominion over the earth, over the fish of the sea and the fowls of the air, and over every living thing. This is the foundation of man’s property in the earth and in all its productions. »] She gave us dominion over Her Creation but not dominion over us. There is no provision for self-governance – we rule over the Creation and She rules over us! How are you going to do Her- to take care and further Her Creation – unless we have dominion over the Creation? Dominion means stewardship (Hildegard von Bingen), it means taking part in the splendid co-creation (Anastasia), it means being an active part in conscious evolution (Elisabeth Sartouris). Holding and exercising God’s power, authority and will gives you God’s dominion and makes you a Servant King, not THE KING OF ALL SERVANTS. [Servant King, Unraveled Series #6  »Oh, my God »].

Here is the logic: all property comes from the land, all material wealth comes from the land. Only the one who owns the land has jurisdiction over it. To get to know something, it is good to go to it’s origin – to know property, let’s go to the origin of property:

In the first scenario, where there is a God who creates everything, then SHE owns everything and she rules over everything. You use your land and your talents as a steward of God. In this scenario you cannot steal the land from anybody or tell anybody what to do with his land, because God owns everything and SHE is your government. You could steal from HER but that, too, is impossible because there can not be two owners of the same thing.


Agnostic Approach

In the alternative scenario where we don’t know whether a God exists – we don’t know who created it, we don’t know to whom the creation belongs. We only know – it’s not us. In this case as well we cannot own property (lawfully or « de jure »). We can only own it de facto, if we just claim anything as our property and defend it. And we have to defend it like animals because in this world any other guy can come along and claim the same thing as his property…

So to protect your property, you would probably create a organization together with like-minded people and fabricate a contract or constitution with them. This constitution will be like an armistice, where all parties agree not to take the property of the other parties of the same club. In the beginning that scheme may work kind of well until? Well, until one of the parties gets clever and creates regulations that will allow him to take some of the other’s property into his own because.

The agnostic will essentially do the same, using different words: “I am put by birth on this land which I don’t know who owns it. It is marvelous and very much enjoyable. So I want to take great care to preserve or better it to my best abilities.”

So both – Theist and Agnostic – have a very humble, responsible and respectful attitude towards the land. We both will feel and act as loving Stewards. Only the lawyer-of-the-jungle will not care about the land because it is just another object in his possession.

 Law of the Jungle approach

The only property you can hold in any country is “personal property”, to own things as the fictitious PERSON. That is so because originally the Creator owns everything and She gives us everything as a dominion. To hold, according to Blacks Law Dictionary, means « To possess in virtue of a lawful title; properly, to have an estate on condition of paying rent, or performing service. »

So to hold is not to own. We hold the Creators property as Her Steward; and perform the service of taking care of the dominion.

In the fictitious world persons hold private property, that means they pay property (land) taxes for holding the property, using it. As the name of the person is owned by the government the property is owned by the government as well and the person can only use it as equity without having any right to it. You see the fictitious world is the copy of the real world only upside down and perverted.

When you register anything with the public, it releases legal title to the government corporation and leaves you with only equitable title – the right to use, not own, and for that use you will pay a ‘use’ tax which is every tax, be it income tax, sales tax, property tax, etc.

Another way to find out how property is owned in the jungle, we have to look at our courts. If two parties claim the right of use of the same property and go to court; the court will decide who will be the legal user; that makes it clear that it is the government/society/court that has the real ownership, the parties only the right of use.

As we have to ask for permits for almost anything, we clearly see that we do not own anything. By begging for a permit or license we ask for permission to use what is not ours. Nothing can be ours because everything belongs to the public, the ‘out of many we are one‘. We could only own something that use, control, manage or dispose of without permit.

If you don’t own anything, you can only borrow things for your use. A borrower is always a servant to the lender. And a borrower is always a user. And using what is not yours requires you to take interest in what is not yours. This is called usury. Also if you don’t own anything, then anything you have must have either come from the trust of the owner OR you stole it from the owner.

In the second scenario we suppose there is no God and we would be the smartest beings around. Consequently we assume the right to rule over everything. As there is no supreme being, there is no supreme law. Now either the strongest will have it all – the law of the jungle – ; or we will be joined in a community with all others and make our own laws to protect our individually held property. In this case the ownership goes from the individuals to the public, the community and the individual will no more possess but just hold property. As the community rules over all in its effort to protect our property… so to protect your property – you loose it!

Because there are only these two possible scenarios, it is clearly proven that there cannot be any privately owned property in a theist (God owns all) or agnostic (nobody knows who owns all) society. The only possibility for private property is in the law of the jungle, and that means fundamental lawlessness. Private property can only be de facto and never de jure.

In order to enslave people the government has to get rid of God and to get rid of THE LAW (to do whatever you want without harming anybody else). The result of which is the total chaos of the law of the jungle. Immediately the government comes in to create the pseudo-law system: rules, regulations, statutes, acts to contain the chaos. As we see today – at the peak of our civilization – all the governments did was masking a de facto situation as de jure. So government produces the chaos that it solves afterward (double profit).

Now we have to make a fine distinction here. In the ‘developed countries’, the governments could not simply get rid of God. So they had to think of something else, they found a finer distinction: in the times of our pristine origin as vedic peoples, we had direct contact with God. We shared the same feelings, had about the same speed of thought (meaning that we could understand HER) and communicated with HER in and through Nature. So the priest who were at the foundation and origin of all government needed to change the relationship the people had with their Creator. It became intolerable that individuals communicate or communed with the Creator directly, the priest had to become the obligatory middle-man. That changed the relationship between us and God: we were cut off from HER to be linked to the priests. This new relationship consequently changed also our identity: henceforth we did not come from HER anymore but from the government, we were not Children of God anymore but only children of the nation. What the priests had to do in order to enslave us, was to manage our knowledge of God. And they did a great job, because the middle-man thing worked right off the bat and evolved until today where virtually all parts of society are secular – meaning we have finally done away with God. And SHE is our ONLY refuge!

And another fine distinction here: it would look very bad if it would really show that nobody owns anything. There were nations in our history that followed that pattern to some extend: the communist states. As they all have really disappeared, that means that the motivation for the people to slave is too low if they know they don’t own anything. So the governments have to create the illusion, the ideology that we can own something.

So that it doesn’t appear that the government now owns the property which you have registered they put it in a name which so much resembles your own that you won’t suspect it, however, this NAME is owned by the government.

 Interlude ~ Lord of the Flies

LordofthelfliesThe novel by Sir William Golding “Lord of the Flies” illustrates very well how the rules will not only cover up the law of the jungle; but how the desire for rules “We got to have rules!” begets the law of the jungle.

The plot

The novel is like a scientific experiment; we are watching a British war evacuation plane crashing on an isolated island in a remote region of the Pacific Ocean. The only survivors are boys in their adolescence.

Two boys—the fair-haired Ralph and an overweight, bespectacled boy nicknamed « Piggy »—find a conch, which Ralph uses as a horn to call all the survivors to one area. Ralph is quickly elected their « chief », though he does not receive the votes of the members of the “Hunters”, led by the red-headed Jack Merridew.

Ralph asserts two primary goals: to have fun and to maintain a smoke signal that could alert passing ships to their presence on the island. The boys declare that whoever holds the conch shall also be able to speak at their formal gatherings and receive the attentive silence of the larger group.

The semblance of order quickly deteriorates as the majority of the boys turn idle, giving little aid in building shelters, and begin to develop paranoia about the island, referring to a supposed monster, the « beast », which they believe to exist on the island. At one point, Jack summons all of his hunters to hunt down a wild pig, drawing away those assigned to maintain the signal fire. A ship travels by the island, but without the boys’ smoke signal to alert the ship’s crew, the ship continues by without stopping.

Jack decides to lead a party to the other side of the island to a mountain of stones, later called Castle Rock. Jack calls an assembly and tries to turn the others against Ralph, asking for them to remove him from his position.

Simon is the sole member of the group to recognize that the « monster » is merely a human corpse. Simon, hoping to tell others of the discovery, finds Jack’s tribe in the island’s interior during a ritual dance and, mistaken for the beast, is killed by the frenzied boys.

Jack and his band of « savages » decide that they should possess Piggy’s glasses, the only means of starting a fire on the island, so they raid Ralph’s camp, confiscate the glasses, and return to their abode on Castle Rock. Ralph and Piggy journey to Castle Rock to confront Jack and secure the glasses. Roger drops a boulder from his vantage point above, killing Piggy and shattering the conch. Ralph manages to escape.

Lordofthelflies1The following morning, Jack orders his tribe to begin a manhunt for Ralph. Jack’s savages set fire to the forest while Ralph desperately weighs his options for survival. Following a long chase, most of the island is consumed in flames, drawing the attention of a passing naval vessel. Ralph suddenly runs into an officer from the warship and bursts into tears over the death of Piggy and the « end of innocence ». The other children arrive and, now realizing what they have done, also spontaneously erupt into sobs.

The starting set, the arrival on the uninhabited island, shows all the kids as one group of survivers. Very quickly they express their common desire “We must have rules!”; the desire for governance, for government. Rasph incorporates the understanding of government of public service, working for the survival and enjoyment of the collective of individuals; while Jack wants the power.
The role of Jack shows quite drastically how man-made rules are always used to consolidate this power structure that is not in place for the common good but to keep the leader on the throne. Very quickly the situation deteriorates, meaning that the power system has got a life of its own and subjugates all the others, including Jack – nobody is left with any freedom except Ralph and Piggy, who refuse to consent and be part of this government.


The logic of property

Property is a peculiar right in real estate and movable things

Property is owned by only the owner to the exclusion of all others. To own property, means that you have the exclusive possession, use, control, management and disposal of the thing to the exclusion of all others…. It’s a peculiar right. Peculiar means ‘one’s own, exclusively yours’; no other man can tell you what to do with what is yours. This is a foundation of Law.
This is exactly what dominion means : to have exclusive and complete right to a land until the creator repossesses it. You can claim ownership until She repossesses it. And that is necessary because you need a material space at your disposal to actualize your (god given) talents, to make your potential a reality. It is not possible to do that in a space that is regulated by an agency who does not consider at all what you need to actualize your potential.

fubarAs soon as God is replaced by government (« ye little gods »), the government owns the property while you only hold public property… privately. You do not own title to anything, you only hold title; a priviledge granted from the owner, the government. You are not a house-owner, you have a household. You hold it as a tenant. You do not own your children, you only hold custody. The owner can change the parent, guardian, babysitter whenever they want using the legal system.

The Canada Criminal Code had provisions for us to defend our personal property. Section 38 stated that (1) Every one who is in peaceable possession of personal property, and every one lawfully assisting him, is justified (a) in preventing a trespasser from taking it, or (b) in taking it from a trespasser who has taken it, if he does not strike or cause bodily harm to the trespasser.1

It got even better under section 39, Defense with Claim of right : (1) Every one who is in peaceable possession of personal property under a claim of right, and every one acting under his authority, is protected from criminal responsibility for defending that possession, even against a person entitled by law to take possession of it, if he uses no more force than is necessary.

Defense without claim of right: (2) Every one who is in peaceable possession of personal property, but does not claim it as of right or does not act under the authority of a person who claims it as of right, is not justified or protected from criminal responsibility for defending his possession against a person who is entitled by law to take possession of it2

A « lawful excuse » is a claim of right. A lawful excuse is obtained by a notice of understanding and an undisputed claim of right – theme of another course…

Unfortunately both sections 38 and 39 have been [Repealed, 2012, c. 9, s. 2]


Property in Land

godparadiseBasically, we don’t need to back up our land ownership claims with anything. If we have rightfully gotten the land, which means without unlawfully having taken it away from somebody else, then we can claim that we have the right of usage. In this sense we don’t need the letter patent, because the Crown actually only leased the land from the natives who don’t believe in land ownership anyway.

As I have shown before, God owns everything because SHE created everything. Then SHE gave us dominion over creation, meaning we can use his creation, land etc as Stewards until SHE repossesses it. In other words we have the land we live on de jure as property as long as he lets us have it.

The Universal Charter of Human Rights states in Article 17:

(1) Everyone has the right to own property alone as well as in association with others.
(2)
No one shall be arbitrarily deprived of his property

 


Property and government

The governments do not have the authority to legislate laws that supersede law as administered by the Crown. Once the Crown has alienated property into private hands, it looses interest and right in it. No municipal law can supersede the Crown Grant. Likewise our governments have no authority to legislate, much less enforce laws that usurp our natural rights as such rights are guaranteed to be protected under those same Crown Grants. The government “acts as if” they have authority. While we give our consent (even as ‘tacit agreement’), we. too “act as if” they have that authority. Until we revoke our consent, we have effectively given up our right of self determination.

Private property is the “Holy Calf” of our legal system. This is well expressed in the British Columbia Land Title Act:

So great moreover is the regard of the law for private property, that it will not authorize the least violation of it; no, not even for the general good of the whole community. If a new road, for instance, were to be made through the grounds of a private person, it might perhaps be extensively beneficial to the public; but the law permits no man, or set of men to do this without consent of the owner of the land…. Besides the public good is in nothing more essentially interested, that in the protection of every individual’s private rights.”
[Blackstone Commentaries, 2:138-9]

Likewise it has been ruled in the 1994 case of the Attorney General of Ontario v. Rowntree Beach Association, “the Queen in right of Ontario has no right, title or interest in and to the lands described…”.

Under Section 92, subsection 8 of the British North America Act (BNA), the provinces have the authority to grant permission to the Municipalities to create by-laws. When Municipalities implement by-laws that are in conflict or frustrate Acts of Parliament, superior legislation, Crown contracts or Crown Grants/Letters Patent, the Council and staff can be found liable to tort action. This includes all members of staff, particularly, the by-law inspector, Clerks, CAOs, and Council, as it is function of these entities to know and understand the implication of all Acts and any conflicts/frustrations that may arise.

Any claim that the Municipalities, Counties, Provinces , etc. , feel they have can be deemed as Trespass of Chattel:

“Trespass of Chattel occurs when the tortfeasor intentionally deprives or interferes with the chattel owner’s possession or exclusive use of personal property. The tortfeasor’s possession or interference must be unauthorized, which means that the owner cannot have consented.”

Intentional torts are any intentional acts that are reasonably foreseeable to cause harm to an individual, and that do so. Intentional torts have several subcategories, including torts against the person, including assault, battery, false imprisonment, intentional infliction of emotional distress, and fraud. Property torts involve any intentional interference with the property rights of the claimant (plaintiff). Those commonly recognized include trespass to land, trespass to chattels (personal property), and conversion.

Based on section 109 of the BNA, which is constitutional law, and is part of our Constitution and Charter, Section 109 limits the provincial power to implement legislation, regulation, policy, etc. only on “public” or “Crown land” (CROWN LANDS – the words “Crown lands”, shall be held to mean and include all Crown Lands, Ordnance Lands (transferred to the Province), School lands, Clergy lands, or lands of the Jesuits’ estates.) and “public/Crown interests”.

Once the Crown has alienated  (ALIENATE – to transfer or convey (property or a property right) to another) the Crown domain4, there is no further and/or future jurisdiction or authority that can be allotted to the province to administer. As the province receives its authority from the Crown, and as the Crown has alienated its authority it has nothing to transfer to the province, in regards to private property, thus the only “property” that the province has authority to regulate/legislate for must be either public or Crown property. The statement of “property and civil rights in the province” and “all things merely local and private in nature in the province”, are restricted to any public and/or Crown lands/property.

Therefore it follows that if the province has no authority/jurisdiction they cannot transfer authority they do not have to any other entity to demand permits/licenses, including third party corporations as in municipalities, the Conservation authorities, commissions, etc. And it is only the private property owner that has the authority to dedicate his property and it is only the private property owner that has the authority to designate his property for the use of the public.

Property tax

Here is the « logic » of property tax:

You have to pay money to use what you own and you have to pay money to keep what you own.

Another logic of property tax shows in the event that the municipality may threaten to seize your property when you do not pay the property taxes. This is called forfeiture: to lose or be deprived of (property or a right or privilege) as a penalty for wrongdoing. But the municipality can only do that if they have granted to you the property in question in the first place. Even though it is their assumption, it is not the case: you bought the land and that had nothing whatsoever to do with the government. They can only forfeit what they granted before: so you have to ask them to show you the document where it proves that you received the land as a grant from the municipality – or be silent.
In this context it is important to note that the Province of Quebec or the municipality of Prevost do not exist on the land; they are commercial zones. So how can my land be part of their land if they do not have any?

The practice of property tax resides on the assumption that the one who registered his property with the government is the Legal Person, who is an agent of government.

The first way to remedy the property tax issue is to challenge jurisdiction. The debate about that in court could be something like this:

I would like to ask you, the City: what does this property tax and codes have to do with me?”

“Because you reside in the territorial limits of the CITY OF PREVOST and as such you stand under the by-laws and consequently have to pay taxes.”

I am not residing anywhere. This is a false claim that I rebut. Do I reside somewhere? Can you prove that? Do you have a witness? – I believe nobody can reside in a fiction like the corporation of the CITY OF PREVOST. Your jurisdiction has no force or effect whatsoever on the land. So that means, you will have to prove me that the regulations of the fictitious corporation CITY OF PREVOST has jurisdiction beyond its being a corporation, a Legal Person, a fiction! The territory of the jurisdiction of the CITY OF PREVOST is also the sales territory of Coca Cola or the protected territory of the Hells Angels of the Russian Mafia…That means on this same territory maybe 5000 different jurisdictions apply – but they individually only apply to the Legal Persons who take part in the respective corporation. The Legal Persons employed by Coca Cola or Tim Hortons are only subjected to the codes of the corporation that they are employed with.”

I wrote to the Premier of the province and also the provincial Advisor for Procedure Policy for Municipal Affairs and asked them both about ‘property tax’. Neither could prove that I am required to pay property tax. The way to stop paying any tax, never mind property tax, is to remember that you are not a Legal Person.
